AUCTION TERMS & CONDITIONS
By registering and bidding, all bidders agree to the following terms and conditions:
Buyer’s Premium
A 10% Buyer’s Premium will be added to the final high bid to determine the total purchase price.
Earnest Money Deposit
The successful bidder shall provide an earnest money deposit equal to 10% of the total purchase price within 24 hours of auction close. Earnest money must be in the form of certified funds or wire transfer and will be held by the title company or escrow agent until closing.
Closing
Closing shall occur within 30 days of auction close through a Texas-licensed title company. Buyer shall pay all customary closing costs including title policy, escrow fees, recording fees, and any lender-related costs.
Property Condition
The property is being sold AS-IS, WHERE-IS, WITH ALL FAULTS, in its present condition with no warranties or representations, expressed or implied, by the seller or auctioneer.
Due Diligence
All bidders are strongly encouraged to independently inspect the property and review all available information prior to bidding. By placing a bid, bidder acknowledges they have conducted their own due diligence and are satisfied with the property.
Bidding & Registration
All bidders must register and may be subject to approval prior to bidding. Auction company reserves the right to approve, deny, or revoke bidding privileges at its sole discretion. A deposit in the amount of $2,500.00 is required prior to bidding approval.
Auction Ending / Extended Bidding
This auction features an auto-extend (soft close). If a bid is placed within the final minutes of the auction, bidding will automatically extend until no further bids are received.
Contract Execution
The successful bidder must execute a Texas Real Estate Contract (promulgated form or similar) within 24 hours of auction close.
Financing
The sale is not contingent upon financing, appraisal, or inspection. Buyers requiring financing must secure approval prior to bidding.
Phase 1 Environmental Survey
Neither the Seller nor the Auctioneer has conducted or will provide a Phase I Environmental Site Assessment. All bidders acknowledge that they have had the opportunity to conduct independent inspections and investigations, including environmental assessments, prior to bidding. By placing a bid, the bidder agrees to accept the property in its current condition and assumes all responsibility for any environmental issues, known or unknown.
