Lemons Auctioneers, LLC, and Online Pros is a licensed auction firm conducting services on behalf of our sellers. As required by Texas law, we must collect sales tax on applicable transactions. According to Texas Tax Code § 151.052, the state imposes a sales tax on the sale, lease, or rental of tangible personal property and certain services. Additionally, Texas Administrative Code § 3.285 specifies that sales made at auction are subject to state and local sales tax, unless a valid exemption applies.
Since we conduct business in Tomball, Texas (Harris County), we are required to collect a total sales tax of 8.25% on taxable items, which includes the 6.25% state sales tax and up to 2% local tax as permitted by law.
Buyers claiming an exemption must provide a valid Texas Sales and Use Tax Resale Certificate (Form 01-339) or other appropriate exemption documentation at the time of purchase. Failure to provide proper exemption documentation will result in sales tax being collected.
For more information on Texas sales tax regulations, please refer to the Texas Comptroller’s Office at https://comptroller.texas.gov/.
To qualify for tax exemption, your online account must be activated for exemption status. Please ensure you use the appropriate form for your situation, which can be found on our website under Auction Resources. We recommend completing the form before making any purchases.
Note: Tax Exempt Forms are only valid for the current year, and a new form must be submitted annually.
To complete the form, you will need to provide your name and address or your organization's name and contact details, the seller's name, the reason for requesting a sales tax exemption, and a list of the items you intend to purchase. The purchaser must sign and date the certification, but unlike a resale certificate, no number is required.
Be sure to sign and date the bottom of the form, confirming that all information provided is accurate and that you understand the penalties for submitting false information.
Once completed, send the application to lemons@onlinepros.com
The ending time for each item is set to Auto Extend, meaning that if a bid is placed within the final 60 seconds before the scheduled closing time, the countdown will reset to 3 minutes. This process will continue until no further bids are placed.
Winning bids will be revealed only after all invoices have been processed following the completion of all auctions for the day.
Invoices are issued by 4:00 PM (CST) and can be accessed under the "Billing" tab. If you have not received your invoice by 4:00 PM,
please contact our office at 281-357-4977.
A Buyers' Premium is a fee implemented by auctioneers to help cover the costs of conducting an auction. As a buyer, determine your maximum budget for an item and cease bidding once your bid, including the premium, reaches that limit. For instance, if a 14% buyers' premium applies and your maximum budget is $50.00, you should stop bidding at $45.00. If the final bid is $45.00, the premium will amount to $4.50, bringing your total to $49.50—saving you $0.50
You must pay for your items won within two consecutive days after the completion of the auction (Including Weekends & Holidays). Example: If you won an item Friday afternoon the payment is due Sunday afternoon. The site has the capability of 24/7 credit card or debit card payments. *All accounts not paid in full by the stated deadline date for $500.00 or less will be automatically charged through our Authorize.net payment gateway with the credit or debit card supplied by the Buyer. The answer is "No." You must pay for any items you've won before participating in future auctions. Payment is required within two days of winning. This rule is strictly enforced—no exceptions.
Please note: Lemons Auctioneers, LLC reserves the right to relist and resell any unpaid items immediately after the auction closes. Failure to pay may result in additional costs related to resale, collection efforts, and any damages caused by the default
Lemons Auctioneers, LLC and Online Pros does not offer shipping. Buyers are solely responsible for the complete removal of their purchased items, whether handling it personally or hiring a pickup and delivery service.
The Owner/Seller is not responsible for packing, shrink-wrapping, palletizing, transportation, lifting, towing, hauling, or any other method required for the removal or transport of purchased items/lots.
Buyer Responsibilities:
*All successful bidders must load and remove their merchandise from its current location as stated on the auction website (www.onlinepros.com).
*No merchandise will be released until full payment has been received by the auction company—this policy will be strictly enforced.
*Buyers must present a copy of their official Paid Invoice and valid identification upon arrival at the Seller’s premises.
Using a Removal Service:
If a buyer hires a third-party service for pickup, they must provide the Owner/Seller and Auctioneer with:
*A signed letter of authorization
*A copy of the paid receipt
The letter of authorization can be found on the Auctioneer’s website under Auction Resources (www.onlinepros.com).

The deadline for removing all merchandise from the premises is specified on a per-auction basis and can be found on the respective auction page. The Owner/Seller and Auctioneer agree that merchandise may remain on-site for a designated period following the auction's closing date. After this final removal date, the Seller may impose a storage fee of $10.00 per day, per item/lot, if outlined in the Seller’s Terms & Conditions. If the merchandise is not removed by the specified deadline, ownership will revert to the original Owner/Seller, who may dispose of or resell the item/lot at their discretion. The defaulting buyer’s account will be suspended, and no refunds will be issued. No exceptions!
IMPORTANT NOTICE: DO NOT LEAVE THE PREMISES
If you have any concerns or discrepancies regarding an item you have won, you must immediately speak with a seller representative at the pickup location. The representative will then contact Lemons Auctioneers, LLC and Online Pros to work toward a resolution.
If you leave the premises with your items without reporting the issue, neither the seller nor Lemons Auctioneers, LLC and Online Pros will acknowledge or be held responsible for the discrepancy.
Please note: This policy is strictly enforced—no exceptions will be made.
No adjustments, refunds, or claims will be accepted after the item or lot has been removed from the premises or after the posted removal deadline, regardless of whether the item was taken.
All sales are final once the items leave the seller’s location.

Titles Are Signed by the Seller and Ready for Buyer Possession:
The seller signs over the title before it is transferred to the buyer, ensuring that the title is properly endorsed and ready for legal transfer to the new owner upon payment.
Prepare New Buyer Information for Buyer/Dealer Possession as Necessary:
The auction house will prepare and update title documentation with the buyer's or dealer’s information. This ensures that the title accurately reflects the new owner and meets all legal requirements.
